California Privacy Notice

The Lubrizol Corporation and its affiliates (collectively "Lubrizol") respect your privacy and are committed to protecting the Personal Information that you may provide while using our websites, or for the purposes of selling products, buying materials and otherwise conducting commercial business. This notice is intended to provide a description of Lubrizol’s practices regarding the collection, use and disclosure of Personal Information and of the rights of California Consumers regarding their Personal Information.

Definitions

  1.  “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information does not include publicly available information or deidentified or aggregate consumer information.
  2. “Sensitive Personal Information” means Personal Information that reveals:
    1. A Consumer’s social security, driver’s license, state identification card, or passport number.
    2. A Consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account.
    3. A Consumer’s precise geolocation;
    4. A Consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership.
    5. The contents of a Consumer’s mail, email, and text messages unless the business is the intended recipient of the communication.
    6. A Consumer’s genetic data.
    7. The processing of biometric information for the purpose of uniquely identifying a Consumer.
    8. Personal Information collected and analyzed concerning a Consumer’s health.
    9. Personal Information collected and analyzed concerning a Consumer’s sex life or sexual orientation.
  3. “Consumer” means a person who is a California resident.
  4. “CCPA” means the California Consumer Privacy Act, Ca. Civil Code Section 1798.100 et seq.
  5. “CPRA” means the means the California Privacy Rights Act, Ca. Civil Code Section 1798.100 et seq.
  6. “Sell” means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Data Subject’s Personal Information by the business to a third party for monetary or other valuable consideration.
  7. “Share” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Data Subject’s Personal Information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.
  8. “Verify” means to determine that the Consumer making a request to know or request to delete is the consumer about whom the business has collected information.

Other terms may be further defined by the CCPA, CPRA, or the California Consumer Privacy Act Regulations, §999.300 et seq.

Collection of Personal Information

 

Lubrizol uses Personal Information to sell products and services, buy materials or services, provide product information, market products or otherwise conduct commercial business.

You have a right to request the deletion of Personal Information collected or maintained by Lubrizol. In order Verify the request, Lubrizol may match Personal Information included in your request with the Personal Information Lubrizol maintains in its records. If Lubrizol is unable to Verify your request, Lubrizol may ask for additional Personal Information.

Right to Correct Inaccurate Personal Information

You have a right to request that Lubrizol correct inaccurate Personal Information. To submit a request to delete Personal Information, please complete the Data Privacy Request Form. You may also call us at 833-582-7496 (833-LUBRIZO). In order Verify the request, Lubrizol may match Personal Information included in your request with the Personal Information Lubrizol maintains in its records. If Lubrizol is unable to Verify your request, Lubrizol may ask for additional Personal Information. Lubrizol will use commercially reasonable efforts to correct the inaccurate Personal Information within 45 days of receiving a verifiable Consumer request

Right to Know What Personal Information is Being Collected/Right to Access

You have the right to request that Lubrizol disclose what Personal Information Lubrizol collects, uses, and discloses about you. To submit a request for this information, please complete a Data Privacy Request Form. You may also call us at 833-582-7496 (833-LUBRIZO). In order to Verify the request, Lubrizol may match Personal Information included in your request with the Personal Information Lubrizol maintains in its records. If Lubrizol is unable to Verify your request, Lubrizol may ask for additional Personal Information. Lubrizol will use commercially reasonable efforts to provide the requested Personal Information within 45 days of receiving a verifiable Consumer request. Access may be denied if allowing access would result in:

•           Disclosing Personal Information pertaining to others.

•           Interfering with future or ongoing negotiations, such as those involving the acquisition of publicly traded companies.

•           Disclosing confidential employee ethics investigations or grievance proceedings.

•           Disclosing confidential information regarding employee personnel files, employee succession planning and corporate reorganizations.

•           Or as otherwise prohibited by law

Right to Know if Personal Information is Sold, Shared, or Disclosed.

Lubrizol does not Sell or Share Personal Information.

You have the right to request that Lubrizol disclose what Personal Information Lubrizol has disclosed to service providers and others for a business purpose. To submit a request for this information, please complete a Data Privacy Request Form. You may also call us at 833-582-7496 (833-LUBRIZO). In order to Verify the request, Lubrizol may match Personal Information included in your request with the Personal Information Lubrizol maintains in its records. If Lubrizol is unable to Verify your request, Lubrizol may ask for additional Personal Information. Lubrizol will use commercially reasonable efforts to provide the requested Personal Information within 45 days of receiving a verifiable Consumer request.

Right to Opt-Out of the Sale or Sharing of Personal Information

You have the right to opt-out of the Sale or Sharing of Personal Information by Lubrizol. However, Lubrizol does not Sell or Share Personal Information.

Right to Limit Use and Disclosure of Sensitive Information

You have the right to direct Lubrizol to limit its use of any Sensitive Personal Information to only that use which is necessary to perform the services or provide the goods reasonably expected by your relationship with Lubrizol. Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

You have the right not to receive discriminatory treatment by Lubrizol for the exercise of privacy rights conferred by the CCPA.
